The terms for using ColdToYes, including your responsibilities when you send email through it.

Agreement

These terms are an agreement between you and [operating entity] ("ColdToYes", "we", "us"). By using the website or the service you agree to them. If you use ColdToYes for a business, you agree on behalf of that business.

Early access

The service is offered in early access. Features may change, be limited or be removed, and the service may be unavailable at times. We may end early access or close accounts that are not used as intended.

Your account

You are responsible for your account, for anything done through it, including through the AI assistant you connect, and for keeping your access secure.

Lawful sending

You are responsible for the emails sent on your behalf and for following the laws that apply to them, including the CAN-SPAM Act and any other laws that apply where you or your recipients are located. Among other things, you agree to:

  • Use accurate sender names and honest subject lines.
  • Include a valid physical postal address where required.
  • Honor opt-out requests promptly and never contact people who have asked not to be contacted.
  • Only contact people for legitimate business purposes.

Acceptable use

You may not use ColdToYes to:

  • Send spam, phishing, malware or deceptive content.
  • Impersonate any person or organization.
  • Contact consumers in ways the law does not allow, or send to purchased lists you have no right to use.
  • Harass anyone or send unlawful, hateful or sexually explicit content.
  • Interfere with the service, other users or email providers, or try to get around sending limits and pacing.

We may pause sending or suspend an account that we reasonably believe breaks these rules or puts inboxes, domains or other users at risk.

Your content and data

You keep ownership of your contact lists, your emails and your replies. You give us permission to use them to provide the service to you. As described in our privacy policy, we may use aggregated sending patterns to improve the service for all users, without sharing your leads, lists or copy with anyone.

AI-written content

ColdToYes uses AI to research and write emails. AI output can be wrong. You are responsible for reviewing or approving what is sent on your behalf, or for choosing to let it send without review.

Inboxes and domains

Inboxes and domains bought through ColdToYes are provided through third-party providers and are subject to their terms. [Attorney to confirm ownership, transfer and cancellation terms for purchased domains and inboxes.]

Fees

Disclaimers

Limitation of liability

You agree to cover claims against us that arise from the emails you send through ColdToYes or from your breaking these terms or the law.

Ending use

You can stop using ColdToYes at any time. We may suspend or end your access for breaking these terms.
